The Ministry of Human Resources and Social Development has called on all establishments to comply with the mandatory issuance of work regulations through the Qiwa platform, via the Regulation Approval service, which aims to organize work environments within establishments and reduce labor disputes that may arise between the worker and the establishment, so that both parties are aware of their rights and their obligations and duties.
The Ministry clarified that there are two types of work regulations: standard and customized.
Standard regulations are those that follow the unified model of the work regulation, which do not require approvals and can be issued and approved “instantly” through the Qiwa platform, provided that the number of workers in the establishment is less than 50. Establishments can make simple modifications to the regulation such as the number of vacation days, the calendar used, working days, and follow the required steps until it is approved and an electronic certificate is issued.
As for the customized regulations, they are mandatory for establishments that have 50 workers or more. Establishments may include in the customized regulations additional terms, conditions, and provisions such as the system of bonuses, annual increases, violations, or any other provisions, provided that they do not contradict the provisions of the Labor Law, its executive regulations, and the decisions issued in implementation of it. The customized regulation is reviewed by law offices or law firms accredited by the Ministry of Human Resources and Social Development to ensure that it does not conflict with the provisions of the Labor Law, its executive regulations, and the decisions issued in implementation of it, and then it is attested and submitted to the Ministry for approval according to the followed procedures.
It is noted that Qiwa platform is a unified, integrated platform that allows access to all labor sector services with a unified login. The platform works to improve the user experience and speed up procedures to serve as a meeting point between establishments and workers in the private sector.
